Contract and terms of sale for the ODOO hosting service on DIZNESS
Article 1: Parties and definitions
This contract is entered into between the service provider and the customer. It takes effect as soon as the customer accepts it electronically when purchasing.
First party (the service provider): Mr. Fetni Youcef, self-employed entrepreneur (auto-entrepreneur), operating under the trade name DIZNESS, with the following details:

He is referred to in this contract as "DIZNESS" or "the service provider". DIZNESS is a trade name and not a separate legal entity.
Second party (the customer): the natural or legal person who orders one of the plans, with the information entered at registration.
Definitions:
- Service: hosting of the Odoo software on servers managed by the service provider, including its operation and technical maintenance.
- Plan: one of the offers available (Essentiel, Business or Premium), with its resources and price.
- Customer data: all information and files entered into the system by the customer or its users.
- User: any person to whom the customer grants access to the system.
- Subscription period: the period paid in advance, monthly or yearly.
- This contract sets out the terms under which the Odoo hosting service is provided to the customer according to the plan chosen. Each plan includes: server setup, Odoo deployment, daily backups, technical monitoring, security updates and technical support related to the hosting.
- The Odoo Enterprise license, which the customer purchases directly from Odoo S.A. if needed.
- Configuration and customization of the system, or development of additional modules.
- User training and data migration from other systems.
- These additional services are subject to a separate quote.
- Taxes: the service provider is a self-employed entrepreneur subject to the single flat-rate tax (IFU); the prices stated are final and no value added tax is added.
- Payment methods: postal transfer (CCP) or bank transfer. An invoice bearing the service provider's details given in Article 1 is issued for each payment.
- Service start: the service is activated within 48 business hours of confirmation that payment has been received.
- Renewal: the subscription renews for the same period; a payment notice is sent 7 days before the end of the period.
- Late payment: 7 days after the due date, the service is suspended and the data is kept. 30 days after suspension, the service provider may terminate the contract in accordance with Article 5.
- Price changes: the customer is notified of any change at least 30 days in advance, and it only applies from the next renewal.
- Refunds: amounts paid for a period that has started are not refundable, unless the interruption is due to the service provider's failure to meet its obligations.
Plans do not include:
Change of plan: the customer may upgrade to a higher plan at any time; the difference is charged pro rata for the remaining period. Moving to a lower plan takes effect at the next renewal, provided the new plan can hold the customer's data.
Article 03: Prices, payment and renewal
Subscriptions are paid in advance in Algerian dinars; yearly payment is equivalent to two months free.

- Back up the data every day and keep the copies for 30 days.
- Respond to support requests within one business day, Sunday to Thursday, from 9:00 to 17:00.
- Not access or use the customer's data except at the customer's request or for technical necessity.
- Provide accurate information at registration and update it when it changes.
- Keep passwords confidential and take responsibility for everything done through its accounts.
- Not use the service for any activity contrary to Algerian law or infringing the rights of third parties.
- Respect the limits of the chosen plan in terms of number of users and storage.
- Pay the amounts due on time.
Limitation of liability: in all cases, the service provider's liability shall not exceed the amount paid by the customer during the three months preceding the damage. The service provider is not liable for indirect damages such as loss of profits, for errors by the customer or its users, or for faults in the Odoo software itself.
Force majeure: neither party is liable for a failure caused by force majeure, such as natural disasters, outages of national telecommunication networks or decisions of public authorities.
Termination:
- The customer may end the subscription by not renewing it, with written or electronic notice at least 7 days before the end of the period.
- Either party may terminate the contract if the other party breaches an essential obligation and fails to remedy it within 15 days of formal notice.
- When the contract ends for any reason, a complete copy of the customer's data is made available for 30 days, after which it is permanently deleted.
Governing law and disputes: this contract is governed by Algerian law, in particular Law No. 18-05 on electronic commerce. The parties shall seek to settle any dispute amicably within 30 days; failing that, it shall be brought before the court with territorial jurisdiction over the service provider's place of business.
Changes to the terms: any changes are notified to the customer 30 days before they take effect, and the customer may refuse them by not renewing the subscription.
